A RESOLUTION OF THE COALITION CALLED ‘VETO SUNRAIL’ OPPOSING THE CENTRAL FLORIDA COMMUTER RAIL PROJECT CALLED SUNRAIL
WHEREAS, a commuter rail Agreement was entered into between FDOT, the Counties of Volusia, Seminole, Orange, Osceola and the City of Orlando Florida in 2007 prior to the passage and impact of property tax reform and a changed economic reality; and
WHEREAS, voters were never allowed to vote on this specific project in a public referendum despite numerous demands to put this to a public vote; and
WHEREAS, on the four occasions that voters have had the opportunity to vote on plans that included partial funding for light rail and commuter rail the voters of Orange, Osceola and Seminole counties have voted against such tax plans; and
WHEREAS, the Federal Transit Authority (FTA) in its 2007 Evaluation of the Central Florida Commuter Rail project stated that the project is not cost effective nor will it serve the I-4 corridor; and
WHEREAS, there is no travel demand in Central Florida to support a commuter rail project as indicated by the projected daily ridership of 3700; and
WHEREAS, the commuter rail project will not result in a reduction of traffic congestion, which is the purpose of a commuter rail system, but would increase vehicular traffic as the near empty commuter trains cross over 120 roads several times an hour resulting in delays of all vehicular traffic on all east/west roadways in four counties; and
WHEREAS, there is no identified or sustainable dedicated funding source to pay for the operating and maintenance costs throughout the 99-year term; and
WHEREAS, there is no sustainable dedicated funding source to support the current regional Lynx Bus System that serves 80,000 commuters and no funding source for the feeder buses that would be necessary for a commuter rail system without an increase in taxes; and
WHEREAS, the annual operating costs have been grossly underestimated while the farebox revenues have been significantly overestimated which will result in a radically larger and unknown financial burden to the Florida and Central Florida taxpayers; and
WHEREAS, the guarantee by FDOT to FTA that a dedicated funding source will be available when the annual operating caps guaranteed to the participating counties and Orlando will be exceeded, FDOT, without voter approval in these counties and Orlando, will divert funds from existing essential transportation and road that serve that region to fund SunRail; and
WHEREAS, the terms and costs of this project represent the most expensive rail purchase in the history of the United States and an abuse of Florida taxpayer funds; and
WHEREAS, the Liability Provision approved by the Florida Legislature in December 2009 shifts responsibility and liability for accidents, injuries and deaths caused by CSX onto the taxpayers of Florida and imposes an indirect and unquantifiable obligation to assume any liability arising out of the operation of the commuter rail system; and
WHEREAS, “social and environmental benefits” promoted by rail advocates are non-quantifiable and subjective and are not relevant to transportation solutions; and
WHEREAS, in 2008 FDOT estimated that the Commuter Rail project would result in the creation of “130 direct jobs and 234 indirect jobs” and now that estimate has risen to an unsubstantiated claim of over 11,523 jobs; and
WHEREAS, Article VII, Section 12 of the Florida Constitution requires an approval of the majority of the electors of a municipality or county for issuance of a certificate of indebtedness payable from its ad valorem taxes, maturing more than twelve (12) months after issuance; and
WHEREAS, no such statutorily required funding approval referendum has been submitted to the voters of the counties and municipalities as intended by the state constitution; and the electorate of Volusia, Seminole, Orange and Osceola Counties as well as the voters of Orlando, Winter Park and Maitland have consequently not voted to specifically approve the funding of any of the annual operating and maintenance expenses associated with the commuter rail system; and
NOW THEREFORE, be it resolved by the VETO SunRail Coalition as follows:
Article 1. This Coalition does not support this project for it is not needed or essential and the voting taxpayers have been denied a right to approve the project by approving a funding source.
Article 2. This Coalition requests that Governor Scott stop the SunRail project based upon the same criteria utilized for stopping the High Speed Rail project: that the taxpayers will be on the hook for cost overruns and there is no return on investment to the taxpayers that would fund it.
Article 3. This Coalition requests that Governor Scott deny the release of contracts submitted by the Florida Department of Transportation to begin construction of the project and re-appropriate funds to the priorities of the taxpayers and to true economic development initiatives that provide for permanent professional jobs that will carry Florida into the future.

I am against the sun rail. According to this blog article, public transporation is also a carrier for bed bugs that could carry VRE or MRSA. Since Florida has: heat, humidity, foreign tourists and immigrants, it is possible this is the perfect storm for bed bugs. Here is a blog link that links to source articles.

Hi, Jim:
Up until now, bedbugs were thought to be harmless from the point of view of carrying diseases. But all that has changed. See: Scientists Discover Bedbugs Carrying MRSA Germ In Study. Instead of [simply] being a pernicious hard to get rid of pest, they may be carrying anti-biotic resistant staph infections and illnesses now.
Some houses have such bad infestations of bedbugs there is no getting rid of them and impoverished people abandon those homes. In some cities, the houses are condemned as unfit for human habitation and destroyed.
Bed bugs are not found just in beds. Major businesses including theaters and news organizations have suffered from bedbugs. People have to be cautious using any public transportation as the last passenger may have dropped some off.
Almost completely eliminated once by DDT, the absence of a toxin to kill them has caused them to proliferate. If they are carrying MRSA and VRE in Canada, can the rest of the world be far behind?
As for MRSA, the staph infection has been spreading fast among commercial fisherman. It seems that having the hands and arms, wet during work hours, from the sea, particularly, has allowed MRSA to spread. Staph likes a warm, wet environment and commercial fisherman not only all have that condition, but also come in contact with one another’s hands and arms frequently, even sharing gloves and aprons and other surfaces that may become contaminated. Many other occupations require workers to have wet hands and arms doing while completing required tasks. Also, visitors on vacations to tropical environments have returned to their homes with MRSA infections. In warmer climates, MRSA lasts longer on surfaces, but now, in colder climates, bedbugs may carry the disease to the host directly.
In the worst cases, MRSA is known as the flesh eating bacteria, but that is usually found in hospitals. The MRSA found in other environments is usually slower spreading and antibiotics can still be used to stop the action. Still, those with compromised immune systems may find it not so easy to heal. Even healthy people exposed to the lesser strains may require hospitalization and IV treatments.
One thing you can do to help yourself is to keep your skin free of cuts, sores, bites, or scrapes, as entry points allow bacteria to get under the skin where the trouble is more serious, and more difficult to cure. You didn’t like bedbugs anyway, but to know they open a hole in your skin, and put bad bacteria in the hole, does nothing to increase your love of them.
It seems logical that bugs which open sores on the skin from biting also pick up and give back these antibiotic resistant strains. One has to be on alert for so much more in a world with widespread travel and insidious pests. – Gordon G.

Why no item in the VetoSunRail Resolution that deals with the fact that Lakeland inherits the additional rail freight that is removed from downtown Orlando to enable SunRail, and receives no funding to aleviate the tremendous negative effect on downtown Lakeland? As former chairman of the lake Conway navigation and control board, truly shocked that the heavily toxic sight for sandlake sunrail location, is not an issue. This contained toxic dump, once breached has very high chance of leaching into upper level of aquifer, and contaminating lake Conway chain of lakes plus ruining our water source. Concerned citizen.

The profits generated by mass transit is not through fare revenue but rather by development in the areas around stations, and through the increased taxes on businesses who receive increseed business due to being in proximity to a station. Then there are cost savings by not having to rely on roads and more road construction to get in and out of the downtown Orlando area. Lets say we pass on SunRail and add 2 more lanes to I-4 instead. For starters, we will have nightmare traffic conditions while the consruction takes place. Once completed, we will once again max out I-4, and be back on this same topic 5-10 years from now, debating about a commuter train versus adding 2 more lanes to I-4. The advantage of trains, as the population increases, we simply make the train longer, or increase frequency. That is a lot quicker and cost-effective to adding another 2 lanes to I-4. Also, ask yourself when was the last time I-4 generated a profit? Its a not a toll-road, and therefore, produces no revenue. So for anyone to argue about losses on SunRail, take into consideration that losses that I-4 generates with initial construction, maintainence, the cost of emergency crews when there is an accident, etc. Mass transit is an essential part of any developed nation and any large city. Mass transit is what will take Orlando into the future.

Thank you for your comments. Please read “Myths and Facts” as well as cost, ridership and jobs information to the left. 3700 riders are projected for this $1.2B start-up. Even FTA gave it poor ratings for “not serving the I-4 corridor” and not being cost effective. Further, the voters never approved this as it requires a dedicated funding source in perpetuity. It is very debatable that 19th century diesel technology will take Orlando into the future.

Has Governor Scott ever had a good word to say about SunRail? I mean EVER? I’m surprised to hear media say he is “close to approving” SunRail. I cannot find a quote anywhere that he says anything good about SunRail. Unless Governor Scott is Dr. Jeckyll and Mr. Hyde (and I don’t think he is) SunRail will join High Speed Rail in the blue prints dump. But keep calling him anyway just in case the liberals are messing with his mind!

I can’t believe commuter rails in Florida is even a topic of conversation. Get real folks. There’s just not that much traffic here. Take a trip to the northeast, then come back home and try to find something else to complain about.
In case you can’t pick up the evening news broadcast anymore because you never made the digital transition: Our state and country are broke, surviving day to day on borrowed money from China. Spending hundreds of millions to benefit only a few hundred is not the smartest way to get out of debt.
Use the money to widen the last 20 miles of I-4 and the I-4/I-95 interchange, so as to benefit tens of thousands daily.

I blame Bud Hedinger for trying to move the people to the Left on this issue.Durring Mobility 20-20 he came up with the People Led Transportation Plan called Mobility 540 after the am dial location of his show.That he was going to present to the local government.He made updates to the Plan in the last 15 minutes of his show for 3 weeks and then on Monday he never made another update and has never mentioned it again.But he has joined the local politicians in dealing with each project seperately and have won each one as Bud will not anyone with a long memory get thru his call screeners.And he says he has the smartest audience in Talk Radio ? He is only fattening his audience with flattery.

I have personally contacted the Gov on this, including a few minutes ago.I have also spoken repeatedly about this bogus issue on my radio program 6PM EDT http://www.watvnetwork.com Until recently, I lived and worked in the very corridor Sun Rail is to serve. I wouldn’t have used it and had many discussions with others in the area and not one person said they would use it. Hardly a replacement for “door to door” car service. One more attempt by a self-serving, out-of-touch with the people legislature to envision what THEY see is best for us serfs, as every good liberal/progressive/socialist/communist does instead of actually REPRESENTING (there’s a concept) the people who elected them, and SERVING them, instead of the other way around. As I’ve been saying for 2 1/2 years, “This is why the Petition to RECALL exists folks. But, like impeachment, if no one is willing to use the process, it is of no value. I understand that the people of Miami, mostly Cuban, recently recalled their Cuban Mayor for doing a lousy job of managing that city’s finances. We need to do that across this state, such as In LEE COUNTY which blew $ 7 BILLION they had around 2006 and recently RAISED property taxes substantially while real estate values continue to plummet. They need to all lose their jobs to balance the budget and punish the incompetent.
As to impeachment, the last Judge impeached AND convicted was over 140 years ago for drunk driving of a horse and buggy. wow!!! They trash and illegally rewrite the Constitution and no one even impeaches. Wake up America while you still can. Who do you think those internment camps are being built for? Why do we permit it?

The New York Times cover story represents a huge opportunity for you. That article indicates that Rep. Mica’s commuter rail project is the least cost-effective rail project in final design IN THE COUNTRY!
The follow-up article can illustrate how one governor had the moral courage to pull the plug on the government’s “legalized rail bribes” that have allowed Rep. Mica to fleece the taxpayers with his pet “pork” legacy project or you can be pilloried next to Mica. Either way, you’ll be on the front page of The New York Times.
The choice is yours. Thanks in advance for making the only rational decision possible. Please kill this outrageous economic boondoggle now! And say “no” to dozens of commuter rail buses circulating daily in our pristine, tranquil Central Park protected by a National Trust “Threatened” listing.

Agreements call for the federal government to pay for half of SunRail’s $615 million construction costs. The state and local governments will pay 25 percent each. Florida taxpayers will also pay $432 million to CSX for the right to share Orlando-area tracks and upgrade the company’s freight operations in other parts of Florida. The state also has liability for any accidents that occur on the shared tracks.
Florida and local taxpayers will split payments for construction cost overruns. The state will cover operating losses for the first seven years of SunRail’s operation. Local governments are responsible for operating losses after that.

Every powerful congressman has to have his own boondoggle or the other powerful congressmen will make fun of him in the locker room. For example, Congressman Murtha’s boondoggle was an international airport built in a remote area of Pennsylvania at taxpayer expense which has only two flights per day and those flights are subsidized by the taxpayer because the airlines would not fly there unless they did due to lack of demand. Well, that sounds like a very good suggestion. The other name we’ve heard is “StunRail” due to its exorbitant costs, lower ridership and government waste.
